ACCEPTANCE OF THE EULA: Please read this EULA carefully before downloading or using the App and Services. You acknowledge that this EULA constitutes a binding and enforceable legal electronic contract between you and Bushra Malik Shaikh ("the Company", "we", "us", or "our"). When installing and using the Ever Ready application (the "App") and Services, you acknowledge that you have read, understood, and agree to be bound by this EULA, and to use the App and the Services according to the provisions set forth herein, and to comply with all applicable laws and regulations regarding your use of the App. In the event you do not agree with this EULA, or any part hereof, you may not use the App, and should uninstall it where applicable.
You hereby represent and warrant that you are at least 13 years old (or the minimum age of digital consent in your country, where higher) and eligible to enter into these Terms. You further represent and warrant that you are not prohibited by any authorized authority, judicial order, or law from entering into any agreement.
We reserve the right to periodically amend or revise this EULA at our discretion. Such amendments shall be effective as of the "Last revised" date located at the top of this EULA. We will make a reasonable effort to post notification in the event that, at our discretion, the changes made are material. We recommend that you review this EULA periodically, as your continued use of the App and Services following the Last revised date will constitute acceptance of, and agreement to be bound by, those changes.
Ever Ready provides a virtual makeup try-on and beauty-recommendation experience, including AI-assisted photoreal previews, personalized product and routine recommendations, beauty analysis, and related features (collectively, the "Services"). The Services are contingent upon availability and continuity of an internet connection. Lack of connectivity may prevent the use of certain Services. The Company, at its sole discretion and subject to this EULA, is entitled to determine the features, settings, pricing, and other tools available as part of the Services, and to modify, correct, add, or remove them.
Subject to your compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, for your personal, non-commercial use. You may not copy, modify, reverse engineer, decompile, distribute, sublicense, or create derivative works of the App except as permitted by applicable law.
To use the try-on and analysis features, you provide a selfie or other photo. You retain ownership of your photos. By using these features, you grant the Company a limited license to process your photos solely to generate your requested previews and recommendations. You are responsible for ensuring you have the right to use any photo you provide. You agree not to upload content that is unlawful, infringing, or that depicts a person without their consent.
Try-on previews, beauty scores, and product recommendations are generated using artificial intelligence and are provided for illustrative and informational purposes only. Results may not perfectly reflect real-world appearance, and product suggestions are not guarantees of suitability, availability, or results. Always patch-test products and follow manufacturer guidance. The Services do not provide medical or dermatological advice.
You agree not to use the App or Services to: violate any law or third-party right; upload another person's image without consent; attempt to gain unauthorized access to our systems; interfere with or disrupt the Services; or use the Services for any commercial resale without our written permission.
The App, including its design, content, software, and trademarks, is owned by the Company and protected by applicable laws. Except for the limited license granted above, no rights are transferred to you.
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
The App and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that results will meet your expectations.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of (or inability to use) the App or Services.
We may suspend or terminate your access to the App and Services at any time if you breach this EULA. Upon termination, the licenses granted to you will cease and you must stop using and uninstall the App.
This EULA is governed by the laws of Pakistan, without regard to its conflict-of-laws principles, except where local consumer-protection laws apply.
